Sir,
Sir, an average human mind is patently incapable of
considering myriad of Acts and processing peculiar facts relevant to each
particular Act to give a reasoned conclusion. Hence any judge dealing with
assortment of various laws sitting in a General court is unable to give a
correct reasoned judgment in reasonable time. People are standing in queues for
30-40 years waiting for decision of their cases.
Whereas
Tribunals
have very less pendency primarily due the fact that they are specialized and
hence decisions are relatively quicker and far better in their correctness.
My suggestion to ensure that several decades old queue of
cases pending in all courts can be brought to an end and will also give
employment to retired judges at all levels is that all cases of various types
like; Rent, Matrimonial, Service disputes including retirement benefits pay and
emoluments etc, 138 NIact, petty offenses, land laws including change of land
use, village common land laws, mines and minerals, tenders, family disputes
including children and minors, etc etc be shifted to different specialized
tribunals on the lines of Consumer forums / tribunals i.e.;
i) District Tribunal
ii) State tribunal
iii) National Tribunal
