Forum shopping Bench fixing by Sunil Choudhary Registrar Judicial High Court

To,      June 19, 2015
The Hon’ble Acting Chief Justice,
Punjab and Haryana High Court, Chandigarh.

Sub; Deliberate attempt of Bench Fixing / Hunting by Registrar Judicial in Criminal Contempt No 1 of 2012.
Sir,
1.     The above mentioned CROCP against me is on a complaint made by J.Surya Kant. On first date, the matter was listed before first puisne judge as per roster. Later when matter was fixed for 23.7.2012, the roster changed to that of J Surya Kant. Office put up a note Dt 20.7.2012 and solicited orders of then Acting CJ Jasbir Singh as to;-
“whether the said case may be listed as per roster.
OR
Nominate an H’ Division bench for listing the above said case.

Office made no recommendation of any particular judge and the choice was left to H’ Acting Chief Justice who ordered;

“DB headed by Justice SK Mittal”. Copy of order is Annexure A.
Justice S K Mittal was then the first puisne Judge.

2.     Thereafter H’ Chief Justice changed. Roster also changed. When case was listed for 29.8.2013, the roster of CROCP was that of J Hemant Gupta and J Fateh Deep Singh. Since J Surya Kant was not in the roster to hear Criminal contempt, the office again put up a note seeking orders of the then Chief Justice Sanjay Kishan Kaul as under;-
‘x’     ‘whether the (case) same might be listed as per roster.
                OR
‘y’     The same might be continued before H division bench presided over by Hon’ble Justice Satish Kumar Mittal.”

Office as per norms/law made no recommendation of any particular judge and choice was left to the Hon’ble Chief Justice who ordered;


“Y”. Sd/- date 3.7.2013. Copy of noting and order is Annexure B.

Inspite of the fact that J Surya kant was not in the roster of criminal contempt, yet case was not listed as per roster but before senior most judge (J. SK Mittal) after first puisne. First puisne judge was earlier acting chief Justice who had passed earlier orders Dt 20.7.2012 Annexure A.

3.     Thereafter H’ Chief Justice changed. Roster also changed. When case was listed for 19.9.2014, roster of CROCP was that of J. S S Saron and J. Mrs Lisa Gill, J. Rajive Bhalla and J Surinder Gupta. The office again put up the same note seeking orders of the then Acting Chief Justice Ashutosh Mohanta as under;-
‘x’     ‘whether the (case) same might be listed as per roster.
                OR
‘y’     The same might be continued before H division bench presided over by Hon’ble Justice Satish Kumar Mittal.”

“proposal as at ‘x’ or ‘y’ above is submitted for approval” was stated by AO Judicial who works under Registrar Judicial Sunil Choudhary. As per norms / law He did not made recommendation of any particular option to the then H’ Acting Chief Justice who ordered;

“Y”. Sd/- Date 18.9.2014. Copy of noting and order is Annexure C.

Meaning thereby that case was not listed as per roster but was listed before first puisne Judge irrespective of the Roster.

4.     When case was listed for 16.12.2014, new acting chief justice had been nominated, Roster had changed to that of J Jeyapaul and J Darshan Singh. Office put up same note;-
‘x’     ‘whether the (case) same might be listed as per roster.
                OR
‘y’     The same might be continued before H division bench presided over by Hon’ble Justice Satish Kumar Mittal.”
AO registrar judicial wrote “in view of order Dt 18.9.2014
‘y’ may be approved. Case was not put up to Chief Justice as nominated
acting chief justice had not taken charge, relying on previous orders of then acting Chief Justice for listing the case before J SK Mittal i.e. first puisne Judge were followed. Copy is Annexure D.

5.     Case was next listed for 23.3.2015. Acting Chief Justice had changed. Roster of criminal contempt was that J. Jeyapaul and J Mrs RR Garg. Office put up same note;-
‘x’     ‘whether the (case) same might be listed as per roster.
                OR
‘y’     The same might be continued before H division bench presided over by Hon’ble Justice Satish Kumar Mittal.”

This time throwing away all norms/law and exceeding his jurisdiction, AO Judicial himself chose the option for the hon’ble ACJ to accept when AO Judicial wrote;
‘x’ above may be approved”, which was accepted. Annexure E

i)      The act of Registrar judicial in specifying which option is to be accepted by H’ ACJ, is beyond his jurisdiction and amounts to bench fixing / hunting.

ii)      Perusal of notings of last 3 years reveals that nowhere earlier the Registrar Judicial ever made such a proposal for listing the matter before a specific Judge as was done on 19.3.2015. This act amounts to bench fixing/hunting by O/o Registrar judicial.

iii)     By selecting the bench, Registrar judicial took upon himself the powers of the H’ the chief Justice and for mere formality putting it before the H’ the Acting Chief Justice for formal nod. AO or Registrar are nobody to fix or recommended any specific bench before which any case is to be listed. Registrar Judicial wanted the matter to be listed before J. Jeyapaul. This also explains why J Jeyapaul took up the matter with extreme bias as mentioned in my letter Dt May 7, 2015. J Jeyappaul happens to be junior to J Suryakant on whose complaint the CROCP is initiated.

iv)     Registrar Judicial took the benefit of the situation that new acting chief justice is from outside and didn’t knew the exact practice and procedure being followed by this High Court and hence could fall prey to the machinations, ulterior motives in fixing a bench of Judge Jeyapaul before which CROCP 1/12 could be listed. The act of o/o Registrar Judicial is not bonafide and smacks of ulterior motives/pressure and undue influence.

v)     During inspection of file, it was noticed that when Registrar Judicial put up the note for accepting of his proposal only the notings dated 20.7.2012 were below his notings Dt 19.3.2015. Other notings were not tagged together with notings dt 19.3.2015 or 20.7.2012. In casual glance orders of successive Chief Justices were not found. It took me a awhile to locate other orders of successive chief Justices which were after some other miscellaneous pages. It appears that there was surreptitious attempt to hide orders of various Chief Justices on the file from the present Acting Chief Justice.

In view of facts stated above it is prayed;
a)     Case CROCP 1/12 be listed before any Division Bench presided by any Judge senior to Judge Surya Kant, though preferably/ideally both the Judges should be senior to J Surya Kant.
b)     Disciplinary action be taken against Concerned official for his act of specifying the judge before which case should be listed. Act amounted to bench hunting / fixing. He exceeded his jurisdiction in his notings amounting to gross misconduct. Earlier also he had made false notings as mentioned in my letter Dt May 14, 2015.

Matter was put up only once before every new A’/chief justice in the year 2012, 2013 and 2014 i.e. only 3 times in 3 years. Now it is put up 3 times in one month before same CJ. Something is wrong. Registrar has no authority to dictate/recommend to the H’ CJ which bench should hear a case. He has no authority to treat the H’ ACJ as his rubber stamp. By doing so he has ex-facie lowered the dignity of the office of H’ Chief Justice. This amounts to criminal contempt of court for which necessary action be taken against Sunil Choudhary.

Why Justice Darshan Singh committed Perjury?



To,

Criminal misconduct / abuse of court / misuse of official position by Sh Darshan Singh ASJ, Special Judge CBI, Chandigarh.

Respected Sir,

On January 1st, 2010 I had written a letter mentioning about corruption in lower Judiciary particularly at ASJ level. I had also mentioned that immorality of a Judge is known by his Judgment. I give herein below practical proof / example of how Sh Darshan Singh an ASJ as Special Judge CBI Chandigarh has abused the Court, misused his official position and thus committed criminal misconduct in case titled CBI VS Ashish Vajpayee. The case was argued on 22.2.2010. On that very day an unknown person (hereinafter called the ‘tout’) approaches my client Sh Ashish Vajpayee and asks him whether he needs an ‘approach’ or ‘contact’ with Darshan Singh which the tout can arrange. Ashish Vajpayee declines. Written arguments are filed in court on 23.2.2010. On 25th Judge mentions in court that case is going both ways. The same day tout again approaches my client who again declines. Thereafter Judge passes the Judgment Dt 27.2.2010. Before I give proof of criminal conspiracy of Sh Darshan Singh ASJ, I will like to give the facts of the case as contained in charge sheet attached as P/1;-

1.     20.12.99    M/S Aradhana papers Pvt Ltd is ordered to be wound-up by High Court of Himachal Pradesh at Simla

2.     02.06.04    High Court of H.P. allows HPSIDC to invite bids for sale of  properties of the Company.

3.     08.09.04    HPSIDC gets maximum bid of Rs 116 lacs.

4.     04.10.04    High Court of HP allows re-advertisement.

5.     28.04.05    HPSIDC accepts maximum Bid is of Bhagwan Saini of Rs 127.51 lacs

6.     02.05.05    Bhagwan Saini sells property to Ram Kumar for Rs 139 lac. Bhagwan Saini makes statement in CBI CourtIn 2005-06, it was not even possible by adding the agriculture income of my father and brother to pay the auction money in those days.

7.     30.5.05      HPSIDC receives fax from Official Liq. that he has received bid for Rs 135 lacs from Satish Chaudhary. HPSIDC writes that OL should move High Court.

8.     01.06.05    HPSIDC files Coy App No 57/05 before High Court HP for acceptance of bid of Sh Bhagwan Saini for Rs 127.51 lacs.

9.     2.7. 05      OL moves Coy App 70/05 for acceptance of bid of 135 lac of Satish Choudhary.

10.    07.07.05    High court HP directs inter-se bidding. Bhagwan Saini Increases to Rs 170 lacs. Satish Choudhary increases his bid to Rs 175 lacs.
Bhagwan Saini states in High Court that he is not interested to buy property which may be sold to Satish Choudhary. Bid is confirmed in favor of Satish Choudhary. Salient features of the order are:-
i)              25% less earnest money to be deposited within 10 days.

ii)              75% to be deposited within 30 days.

iii)             In case above amount not deposited property to be sold to Sh Bhagwan Saini for Rs 170 lacs on same terms as above without any further reference to court. Bhagwan Saini again states that property be sold to Satish Choudhary and his money be refunded. Court accepts and directs refund of his earnest money.

11.    25.7.05      Sh Bhagwan Saini withdraws his earnest money.

12.    10.8.05      Cheques of Rs 28.75 lacs received back in office of OL with remarks ‘not sufficient funds’.

13.    02.09.05    Note put to OL who orders that notice be issued to Satish Chaudhary calling amount by DD, forfeiture and for initiation of action u/s 138 NI Act.

14.    22.9.2005  Clerk issues Notice u/s 138 NI Act,

15.    8.11.2005 Entire payment of Rs 160 lacs received by DD                        
 
16.    1.4.2006    Sale tax Deptt files application for recall of order Dt 7.7.05 of confirmation of sale

17     31.5.06      FIR registered.

18     28.12.07    Satish Chaudhary files application for condonation of delay in depositing balance sale proceeds.

19.    11.1.08      Court orders interest for delayed period to be deposited.

20     15.3.08      Interest for delayed period deposited in High Court of HP.

20.    4.6.08               High Court of HP condones delay.

21     7.8.06               Charge framed.

22     27.2.10      Convicted for two years for cheating of Rs 5.00 lacs which    assumes payment of Rs 170 lacs by Bhagwan Saini.
How above sequence of events lead to loss / cheating beats common sense. The Judge is not incompetent but thoroughly corrupt. It is a common knowledge that a judge speaks through his Judgment and so does his immorality. (Emphasis supplied). Copy of written arguments is attached P/2 and Judgment is P/3.

1st proof of abuse of court/Judicial/criminal misconduct by Darshan Singh;-

Sh Darshan Singh ASJ has deliberately lied at page 23 with intent to mislead and deceive while writing about the evidence given by PW 15-Bhgawan Saini. He has untruthfully with dishonest intentions concealed to mislead the reader the actual testimony of Bhagwan Saini which is:-.
“I and my group members did not have the financial capacity to pay Rs 127 lacs at the time of auction. I was not an Income tax payee in the year 2004-2005 though I had obtained PAN number. Similar was the position in the year 2005-2006. It was not even possible by adding the agriculture income of my father and brother to pay the auction money in those days. I had deposited a sum of Rs 46,88,000/- including the earnest money at the time of Bid. I cannot separately tell from whose accounts the drafts Dt 28.4.2005, 21.5.2005, for total of Rs 17 lacs were purchased. It is correct that drafts Dt 19.5.2005, 20.5.2005 & 21.5.2005 were purchased from the accounts of Sh Ram Kumar. We have sold this unit privately after 2/3 days of the Bid to said Sh Ram Kumar and a written agreement was reduced into writing. The photocopy of the same is Ex D-4 (Objected to on mode of proof being Photostat copy). I also admit genuineness of the endorsement marked ‘X’ on the back of the agreement Exhibit D-4 which also bears my signatures.” D-Ex D-4 was of Rs 139.00 lacs executed in May 2005.   

This testimony demolishes the entire case of cheating as made out by Judge. The whole case of loss of Rs 10.00 lacs is based on assumption that Bhagwan Saini had Rs 170.00 lacs to pay. If Bhagwan Saini did not have Rs 170.0 lacs there is no question of loss. Since tout of Sh Darshan Singh was not entertained judge has abused the court/ violated his oath of office / misused his official position to punish Sh Ashish Vajpayee for not acceding to his tout. Testimony of Bhagwan Saini is attached as P/4.

2nd proof of abuse of court/Judicial/criminal misconduct by Darshan Singh.

Sh Darshan Singh ASJ has deliberately lied at page 23 with intent to mislead and deceive. He has manipulated the statement of PW 17- Avinash Saini. He has dishonestly untruthfully concealed to mislead the reader the actual testimony of Avinash Saini is:- copy of his statement is attached as P/5.

I did not verify the antecedents of Bhagwan Saini about his occupation and financial position. I did not verify in my investigation as to what Bhagwan Saini was actually doing for earning his livelihood. .. I have not verified the fact that whether Bhagwan Saini was financially sound to pay the remaining sale price. I did not verify the bank accounts of Bhagwan Saini to ascertain the balance therein. I cannot say that there had been never even a balance of Rs.1 lac in his bank accounts as I had not inspected his bank accounts ... did not verify that Bhagwan Saini had stage managed a drama for keeping the bid and for projecting the bid money without having any financial position to purchase the unit. .. I have not investigated the case from the angle that in fact Bhagwan Saini the other bidder had played the fraud with the system and had given the bid without having the requisite money to purchase the unit and also lodged the false claim before the Hon'ble High court.   …. “It is correct that as per the rules it is the duty of the official liquidator to obtain maximum amount for sale of the assets of the unit. It is correct that if accused Ashish Vajpayee could not have brought to the notice of the Hon'ble High court about the higher bid the bid of Rs.1.27 crore would have been confirmed by the Hon'ble H.C. .. It is correct that accused Ashish Vajpayee had acted as per the rules and regulations of the department, .. I had not even came to know about the order dated 4.6.08 after filing of the challan. This order has been shown to me today in the court by the learned defence counsel.” EX D 13. …Accused official liquidator had made the efforts and as a result of that the bid of Rs.1.27 crore has increased to Rs.1.75 crore in the Hon'ble High court” …

The above testimony demolishes the entire investigation and supports A-1. Hence the Judge has lied about the testimony of Avinash Saini at page 23 of his order. Lies by a judge in his order tantamount to criminal misconduct involving moral turpitude, abuse of official position and abuse of court. The judge has lied in his order to give a false impression to a reader to derive pecuniary benefit.

3ndproof of abuse of court/Judicial/criminal misconduct by Darshan Singh

Sh Darshan Singh ASJ has deliberately lied at page 23 with intent to mislead and deceive. He has manipulated the statement of PW 17- Avinash Saini. He has untruthfully concealed to mislead the reader about collusion of A-1. A-2. IO Avinash Saini stated:-

“I have also investigated the allegations concerning sale of assets of M/s sun Fill oil Pvt. Ltd. Village Masana, G.T. Road Kurukshetra, against the accused. In the course of that investigation was found that accused Satish Chaudhary was the highest bidder for the purchase of that unit for the bid of Rs.2.55 crore. It was also revealed during the investigation that Markendeshwar Education Society has offered Rs.50 thousand more over the bid of accused Satish Chaudhary after the close of the bid and the bid of the Satish Chaudhary was stayed by the Hon'ble High Court. It is correct that accused Ashish Vajpayee has recommended for cancellation of bid of Satish Chaudhary and for confirming the bid in favour of Markendeshwar Education Society.”

The above testimony demolishes alleged collusion between Ashish Vajpayee and Satish Choudhary. The Judge has lied about the testimony of Avinash Saini at page 23 of his order. Lies by a judge in his order tantamount to criminal misconduct involving moral turpitude, abuse of hi official position and abuse of court. The judge has lied in his order to give a false impression to a reader. Testimony of IO Avinash Saini is P/5.

4thproof of abuse of court/Judicial/criminal misconduct by Darshan Singh

Sh Darshan Singh has untruthfully mentioned the order of High Court of HP Dt 7.7.2005 at page 49-50 of his order. He has deliberately lied with intent to mislead and deceive. He has deliberately concealed that part of the order which is pari materia. He has indulged in deception to mislead the reader. In the order of High Court Dt 7.7.05, it is recorded;-

“Mr Bhagwan Saini states that assets of the Company may be sold to Mr Satish Chaudhary and money deposited by him be refunded alongwith interest accrued thereupon”  …..
The statement was accepted and the Court ordered;- “Amount of Rs 48.00 lacs which has been deposited by Mr. Bhagwan Saini shall be refunded to him along with interest which may have accrued on this amount immediately after one week from today.”

The above part of the order coupled with the action of Bhagwan Saini to withdraw his earnest money precludes any offer to be made to Bhagwan Saini. The Judge has lied at page 49-50 of his order about the Order of High Court of H P Dt 7.7.05. Lies by a judge in his order tantamount to criminal misconduct involving moral turpitude, abuse of official position and abuse of court. The judge lied in his order to give a false impression to a reader with intent to derive pecuniary benefit. Copy of High Court order is P/6.

5thproof of abuse of court/Judicial/criminal misconduct by Darshan Singh

The judge has lied in para 52 of the order to state that it is a practice to receive payments in cash in government departments. I have yet to see even a single department which receives payment of 1.00 crore in cash, neither it has ever been done in office of Official liquidator. Again payment is insisted in DDs where on receipt of DDs consideration is parted with. On receipt of cheques no consideration was parted with.

6thproof of abuse of court/Judicial/criminal misconduct by Darshan Singh

Sh Darshan Singh ASJ has deliberately lied at page 48-49 of the order with intent to mislead and deceive. He has indulged in large scale deception and in blatant abuse of court he has intentionally concealed the evidence that on 2.5.2005, Sh Bhagwan Saini had sold the property to Sh Ram Kumar for Rs 1.39 Crores. Demand drafts of earnest money bearing SBOP draft No 736235 & 736214 both Dt 20.5.2005 DW 6/1-4,  PNB Nalagarh Draft No 806977 & 806998 Dt 19.5.2005 & Dt 20.5.2005 for Rs 5,00,000/- and Rs 2,00,000/- DW 5/1-7, PNB Baddi drafts No 965824, 414653 & 414654 Dt 19.5.2005 & Dt 20.5.2005 for Rs 6,00,000/- and Rs 1,00,000/-, DW7/1-7, PNB Chandimandir Draft No 52516  Dt 19.5.2005 DW 1/1-3 received by Bhagwan Saini (seller) from Sh Ram Kumar (purchaser) are deposited by Bhagwan Saini with the HPSIDC/ High Court vide Exhibit PW14/9. Same drafts Numbers are tendered by HPSIDC to official Liquidator. Statement of Bhagwan Saini :- PW 15 – “We have sold this unit privately after 2/3 days of the Bid to said Sh Ram Kumar and a written agreement was reduced into writing.” (Agreement to sell is only for Rs 139.0 lacs is attached as P/7).

If this single evidence was mentioned in the order, the outcome would have been different. ASJ Sh Darshan Singh has indulged in wholesale fabrication of evidence to draw the conclusions unwarranted by evidence.
7th proof of abuse of court/criminal conspiracy by Darshan Singh ASJ;-

That Sh P K Dogra & Sh Negi PP for CBI had also stated to ASJ Darshan Singh that Ashish Vajpayee is a moneyed person. His family owns 15 acres of land in Raipur, Chhattisgarh. His wife had purchased property worth seventy lacs and owns gas agency. We failed to understand relevance of this argument to case or why a stranger (tout) had approached us. We could draw the conclusion only after the reading the judgment. Another proof of criminal conspiracy, blatant abuse of court is not recording statement of counsel as made in court. On arguments on sentence PP argued that huge loss has been caused to state as per his statement contained in para 4 at page 72. I had referred to statement of witnesses as below and contended that these is no loss but gain of fifty lacs;-
Statement of IO Avinash Saini PW 16;- “It is correct that as per the rules it is the duty of the official liquidator to obtain maximum amount for sale of the assets of the unit. It is correct that if accused Ashish Vajpayee could not have brought to the notice of the Hon'ble High court about the higher bid the bid of Rs.1.27 crore would have been confirmed by the Hon'ble H.C. .. It is correct that accused Ashish Vajpayee had acted as per the rules and regulations of the department, ..
Statement of PW 14 Sh Chetan Sharma;- “It is correct that if the Official Liquidator would not have moved the petition for the higher bid before the Hon'ble HP High Court the auction of Bhagwan Saini of Rs.127 lacs may have been confirmed by the Hon'ble HP High Court.”
Statement of Bhagwan Saini PW 15:- ”in the year 2005-2006. It was not even possible by adding the agriculture income of my father and brother to pay the auction money in those days.”

The judge dishonestly with intent to derive pecuniary benefit refused to record my statement and PP himself dictated the answer.

Similarly Material evidence and arguments have not been discussed in the order. We understand that whenever demands are not met, material part of judgment is written by PP P K Dogra which is delivered at home of judge in form of pen drive.

It is therefore prayed that a case for criminal / Judicial misconduct, abuse of court/ moral turpitude, misuse of official position with intent to derive pecuniary benefit be registered against accused Darshan Singh ASJ Special Judge CBI, Chandigarh and he be tried and convicted in accordance with law.

5. Water Vending Machine at low cost to the passengers at identified Railway stations.

7. Food safety. First workshop of all Food Safety Officers, Designated Officers & IRCTC Officers was held in Kolkata to improve the standard of food safety in Indian Railways.

Executive Lounge: to provide value added services at a charge, offering facilities such as WiFi Internet, buffet services, wash and change, concierge services for pre-departure and post-arrival assistance to passengers.  IRCTC is in the process of setting up Executive Lounges at 48 more stations.

9. Concierge Services:  Indian Railway Catering and Tourism Corporation (IRCTC) has introduced concierge services (pick-up & drop and porter services), as Pilot Project at a few railway stations.  The stations are New Delhi, Mysore, Bhubaneswar, Howrah, Patna, Secunderabad, Jaipur, Tirupati, Ernakulam, Lucknow, Chandigarh, Lucknow Jn., Delhi, Hazrat Nizamuddin, Delhi Safdarjung, Anand Vihar Terminal, Delhi Cantt, Delhi Sarai Rohilla, Vijayawada, Guntur, Ahmedabad and Sabarmati Jn.

10. Mid-Segment Tourist train:  The all inclusive round trip packages covers rail transportation in different air-conditioned classes, local transportation, guided tour for sightseeing in groups, variety of meals and hotel accommodation etc.  To begin with, a train on the circuit Delhi – Jaisalmer – Jaipur – Delhi commenced operation on 13.12.2015 while the second one on the circuit Delhi – Varanasi – Khajuraho – Agra – Delhi is scheduled to commence operation on 20.12.2015.

11. New Trains : - Upto November, 2015, 112 new trains and 15 extension of trains and 5 increase in frequency have been implemented as announced in Railway Budget 2014-15.  In view of existing backlog, No new train was announced in Railway Budget 2015-16

12. Augmentation : - Upto November 2015, Indian Railways attached 691 coaches thereby generating an additional capacity of 45605 berth/seats.

13. Special Trains : - in the year, for peak seasons 23666 special trains trips were run to clear the extra rush of passengers.

14. Election Special :-       During election in the State of Bihar, 36 Special trains were made to run.

15. Mela Special :  During Sinhastha Kumbh Mela Railways arranged additional rakes (of 236 coaches) and 32 cars of MEMU/DEMU rakes , 608 special trains were run and 795 coaches were temporarily augmented. Besides, 789 GS coaches of regular train services were earmarked for the pilgrims.

16. Non-Budget Trains :  13 pair Non-Budget new trains have been introduced upto December 2015.

17. Experimental Stoppage in trains : - During the current year  upto November, 2015, 146 stoppages have been provided in Mail/Express trains (in single) on an experimental basis.

18. Computerised Parcel Management System implemented on New Delhi – Howrah, New Delhi – Mumbai, New Delhi – Chennai, Howrah-Chennai and Howrah-Mumbai route.

19. Computerisation of Retiring Room booking launched at more than 480 locations.

26. Lower berths to senior citizens :  With a view to facilitate senior citizens and female passengers when travelling alone, a combined reservation quota of two lower berths per coach in Sleeper class has been enhanced to four lower berths per coach is Sleeper class.

27. Timings for advance reservation : - Time limits for booking reserved tickets was increased to 120 days w.e.f. 01.04.2015. This has facilitated the passengers to plan their journey well in advance.

28. Fitment of dustbins in all coaches including non AC coaches.

29. A special train on Gandhi Circuit covering places related to life and work of Mahatma Gandhi run.

30. It has been decided to provide stainless steel mug with chain arrangement in Non-AC coaches also as being provided in AC coaches.


21. 1,098 Rkms Optical fibre cable Cumulatively, 48,818 Rkms (approx.) has been commissioned over Indian Railways enabling high speed communication network.

22. A new Video Conferencing System connecting Civil Engineering officials of Railway zones based on latest state of art technology has been commissioned in Board. This system has the provision of two concurrent Multi Part Conference of 60 participant of Railway Board & Zonal Railway having provision of simultaneous display of 24 participants of single screen.

 23. 2 locomotive factories at Madhepura and Marhowrah successfully bid after 7 years.

 24. Modern LHB Coach manufacturing facility Phase-1 commissioned at ICF Chennai. Indian Railways will shift 100% to 160 kmph fit LHB coaches in next 5 years.  

25. ICF Chennai has developed first of its kind stainless steel 3 phase energy efficient AC-AC transmission 1600 HP DEMU train set. The first  air-conditioned DEMU   was manufactured this year by ICF.

26. DLW Varanasi developed designs and manufactured 5500HP Diesel Locomotives. Moving towards Make in India – Design in India.

27. Indian Railways signed an Assured Off Take Agreements (AOT) for manufacturing of 1200 wagons per annum and rehabilitation of 300 wagons per annum for a period of 10 years with SAIL-RITES Bengal Wagon Industry Pvt. Ltd. (SRBWIPL)  Kulti, West Bengal

28. Traction Alternator Factory at Vidisha, Madhya Pradesh established which will manufacture 100 traction alternators per annum of high horse power diesel locomotives which are currently being imported

29. Automotive rebate for Traditional Empty Flow Direction Traffic with a view to convert empty running of rakes into loaded one, automatic freight rebate scheme has been introduced.

30. Proposals under different Railway schemes like Private Freight  Terminals (PFT), Special Freight Train Operator Scheme (SFTO), Automobile Freight Train Operator Scheme (AFTO), Liberalized Wagon Investment Scheme (LWIS), Wagon Leasing Scheme (WLS) pending since long have been finalized.

31. Mobile Application for Freight Operations (PARICHAALAN) launched.

32. The prototype of the 25T axle load BOXNS wagons has been made during Oct’15. The wagon will run at 100 kmph in loaded and empty condition with pay load to tare ratio of 4.1 as compared to conventional BOXNHL wagons, which have payload to tare ratio of about 3.6.

33. An Memorandum of Understanding with LIC of India was signed on 11.3.2015 for committed long-term funding   to the tune of Rs 1.5 lakh crore over 5 years for financing Railway projects.  First tranche of Rs 2000 cr has been received.

34. MOF approved issue of tax free bonds by IRFC amounting to Rs.6,000 crore during the FY 2015-16; the entire amount has been raised from the market.

35. World Bank was approached to explore the possibility of setting up a Railway Infrastructure Development Fund for raising resources for long term investment in Railways.   A detailed scope and options study has been commissioned by World Bank which is currently in progress.

36. World Bank loan of USD 650 million to finance Eastern DFC – Phase 3 (Khurja-Ludhiana & Khurja-Dadri section) has been negotiated as a direct loan to DFCCIL under Govt. of India guarantee.

37. IRFC’s proposal to raise a Syndicated Foreign Currency Loan of USD 400 million to re-finance an earlier ECB of the same amount, aimed at achieving a saving in debt service costs by about Rs.33 crore, has been agreed and backed by MOR.

38. Identification of projects leading to removal of network decongestion was done and these projects were prioritized for dedicated financing and targeted execution. These projects have been provided adequate funding to enable timely completion.

 39. For prompt and speedy execution of Railway Projects, it was decided to delegate full powers to General Managers for acceptance of tenders. The powers to revise estimates have also been enhanced.

40. The policy guidelines on station redevelopment on Swiss challenge mode, were finalized and issued.

41. Model Concession agreement for Customer Funded model was finalized and issued.

42. Model Agreement for EPC was finalized and issued.

43. Working towards ‘Zero Accident’ Mission. Train Protection Warning System (TPWS): TPWS is a safety Automatic Train Protection (ATP) system conforming to European Train Control System (ETCS) Level-1.  It eliminates accidents caused by human error of Signal Passing at Danger or over speeding by loco pilot. TPWS trials at 160 Kmph were successfully conducted during the year on Nizamuddin-Agra Cantt. Section after completion of requisite works. This section was also made signalling fit for speed potential of 160 Kmph by executing required signaling system upgradations during the year.

44. Enhancement of Safety at Level Crossing Gates: 282 Level Crossing Gates have been interlocked with Signals to enhance safety.

45. Train Collision Avoidance System (TCAS): To overcome shortcomings of ACD system due to its dependence on GPS and for large scale deployment on Indian Railways, a cost effective indigenous safety system – Train Collision Avoidance System (TCAS) is being developed indigenously by RDSO in association with Indian Vendors.  This system is aimed at providing dual capability of preventing train accidents caused due to Signal Passing at Danger (SPAD) or non observance of speed restrictions by train drivers as well as preventing train collisions caused due to non-observance of rules in case of manual operations. RDSO has finalized the Specification after successful proof of concept trials.  Field work for Extended field trials of TCAS with 40 locos on 3 sub-sections in Lingamapalli-Vikarabad-Wadi-Bidar section, SCR (250 km) having RE/Non-RE, Single Line/Double Line Absolute Signalling section with diesel and electric locos are in advance stage of progress by RDSO & SCR.

47. Provision of Integrated Security System (ISS). ISS at 5 stations namely Trivandrum, Mangalore & Ernakulum (SR), Triputi (SCR), Thane (CR) has been commissioned. In addition to that, CCTV system has been commissioned at 10 stations namely Miraj (CR), Bengaluru, Yesvantpur, Mysore(SWR), Bhubaneswar, Puri, Cuttack, Visakhapatnam (ECoR), Bhopal & Itarsi (WCR).  Cumulatively, ISS at 63 stations has been commissioned over Indian Railway. In addition to that, CCTV system has been cumulatively commissioned at 19 stations over Indian Railway.  CCTV surveillance system has been provided at 21 PRS/UTS locations.

48. In the current year from 1st April to 10th December, 2015, consequential train accidents decreased from 105 to 81 in comparison to the corresponding period of the previous year.

49. During the current year from January to 10th December 2015, safety drives were launched by Board on prevention of cases of SPAD, prevention of accidents at unmanned level crossings, observance of rules and precautions during shunting, prevention of cases of fire in pantry cars, observance of rules for working of push trolleys, etc.

50. High Level Safety Review Committee (HLSRC): HLSRC under the Chairmanship of Dr. Anil Kakodkar, former Chairman, Atomic Energy Commission submitted its report on 17.02.2012.  The HLSRC has made 106 recommendations covering the various aspects of Indian Railways.  All the recommendations have been examined by the Board.  Out of the 106 recommendations, 68 have been fully accepted and of which 22 have been fully implemented and 46 are under implementation. The remaining 38 recommendations are under active consideration in the Ministry of Railways for appropriate action in a phased manner.   

51. Proposal invited for installation of ‘Fracture Detection System’ to detect Rail/weld failures and prevent derailments.

52. Fire extinguishers in Non Air-conditioned coaches are being installed.

53. Provision of double acting AC compartment swing doors on coaches for faster evacuation of passengers in case of fire emergency.

54. Automatic fire and smoke detection system for Non AC coaches was installed for the first time.

55. Fire suppression system in Pantry cars and Power cars was installed for first time as these are more fire prone than other passenger coaches.

56. 1479 route kilometers have been electrified from January’ 2015 upto 15th December’ 2015.

57. Modern Signalling system with Route Relay Interlocking (RRI)/ Panel Interlocking (PI)/ Electronic Interlocking (EI) along with Multi Aspect Colour Light Signalling (MACLS) has been put in place at 299 stations replacing over-aged Mechanical/Multi Cabin Signalling system.

58. Automatic Block Signalling has been commissioned on 141 Route Kms.

59. Filament signal lamps are being replaced by long life, highly durable LED signals. 171 stations have been provided with LED signals.

                                               GREEN INITIATIVES

60. Railway has already provided Solar panel on roof top of coaches for train lighting system in 2 broad gauge coaches & 4 narrow gauge coaches plying on Pathankot-Joginder Nagar section in Kangra Valley and fourteen narrow gauge coaches plying on Kalka-Shimla section on trial basis.

61. Tender document & policy guidelines for 50 MW solar plants at rooftop of Railways buildings issued. 10 Railways have issued tenders accordingly.

62. Commissioned 25 MW wind mill power plant at Jaisalmer in October, 2015 which has already supplied 40 lakh units till now.

63.     1000 MW solar power plants being set up over next 5 years; 10.5 MW already set up; in 2015-16, additional 6.5 MW will be set up ; PPP model finalized.

64. Till Nov-2015, 7621 bio Toilets has been fitted in 2144 coaches. The cumulative fitment of Bio Toilets till date is 27800 Bio-Tanks in about 9200 coaches.

65. An innovative Indian design of a Bio-Vac Toilets, a  Hybrid  of Vacuum Toilet and Bio-Toilet is working successfully.

66. Bio diesel: Use of bio diesel has been started.

67. CNG DEMU: CNG DEMU power cars introduced on Northern Railway to make commuter trains environment and user friendly.

68. Water Recycling Plants (WRPs) at 10 coaching depots got sanctioned in Budget 2015-16. In addition, 32 stations have been identified for provision of WRP.

69. In the current year of 2015-16, recruitment process is underway for about 48,500 Group ‘C’ posts with RRBs.  Out of these 48500 vacancies, panels for about 10800 RRB empanelled candidates have since been supplied and process for the remainder is on.

70. In a quantum leap towards achieving greater transparency, objectivity and credibility, IT based recruitment system for Group ‘C’ posts has been initiated by the RRBs.  A Pilot Project of Computer Based (On-line) applications and examinations for 54 categories of Senior Section Engineers (SSEs), Junior Engineers (JEs) and Chemical and Metallurgical Assistants (CMA) has been completed successfully.

71. Positive efforts have been made to reduce the time taken for recruiting Group ‘C’ category staff from open market.  In this process, Computer Based examination for SSE/JKE has been conducted within one month from the closing date of application.  This has been possible due to the initiative of calling of On-line (IT based) application.

72. As a measure of transparency, question paper, answer sheet and answer keys for SSE/JE examination 2015 have been uplodaded on RRBs’ websites providing an opportunity to the candidates to view their performance and to submit any objection.  Candidates were also advised of this facility through individual emails/SMSs.

73. In order to reach out to the employees directly, Hon’ble MR had desired to convey personal   Birthday wishes to every employee through SMS on mobile phone or letter.

75. Railway Recruitment Cells, since their formation in 2005, are into the fourth cycle of conducting recruitment to posts in Grade Pay Rs.1800/-.  They have notified around 62000 vacancies in the year 2013 and are in the process of completion of the same without any untoward incidents. So far, panels of around 38000 persons have been published which includes panels of around 850 persons with disabilities.

76. On board house keeping now includes all important mail & express trains As against 34 last year, 74 trains has been covered in the current year for Onboard  House-keeping.

77. Advisory sent to ZRs on 23.04.2015 for taking up Special Intensive Cleaning drive at stations and being monitored. 11 ZRs have so far taken action at 226 stations.

78. 27 Charitable Institutions/Social Organizations were invited to take part in ‘Swachh Rail, Swachh Bharat Abhiyan’ through Shramdan campaign.  16 Organizations have already launched their action in this regard.  One of the organizations viz. Sant Nirankari Charitable Foundation offered is undertaking this campaign at 45 major Stations of IR & KRCL.

79. 233 projects/works of passenger amenities and services ranging from escalators, foot over bridges, station buildings, reservation offices, new platforms, new train services etc. were commissioned/opened for the railway passengers at an approximate cost of Rs. 4000 crore.

80. Work on 73 projects connected with passenger amenities and augmentation of network capacity was commenced costing approx. Rs. 550 crore.

81. Over 7000 Railway stations were inspected by railway officials and taken up for improvement in various passenger amenities.

82. 4000 road shows were undertaken by senior railway officers at railway station premises and in trains to interact with rail users, obtain their suggestions and taking feedback on the railway services provided.

83. Passenger outreach through railway officers and staff, unions, NGOs, scouts, guides, charitable organizations and through social media touched over 7 million passenger and public ( Face Book reach -5 million, Twitter Impressions- 1.3 million and .7 million passenger interactions at stations and in trains).

84. 7500 cleanliness and sanitation drives and inspections were undertaken at various stations, railway premises and colonies under ‘Swatch Bharat Abhiyan’ with the involvement of railway staff, passengers and NGOs.

85. 2700 catering services checks were undertaken in order to ensure quality of catering services and standards of hygiene at various stations and in trains.

86. 4600 intensive ticket checking drives were launched to curb the menace of ticket less traveling and to prohibit the entry of antisocial elements.  These drives resulted in detection of 1.6 lakh cases and recovery of Rs. 9 crore of railway revenue.

87. 3000 inspections for improving punctuality of trains were undertaken during this period.

88. 1400 inspections were conducted to check the presence of antisocial elements, touts and other irregularities by teams of vigilance officers.

89. Intensive safety awareness drives were launched on all Zonal Railways with focus on precautions to be taken by road users at unmanned level crossing gates.  8500 such inspections were conducted by railway officials.

90. 126 Skill Development Programmes were organized in various Railway Workshops and Production Units to impart training to 5500 persons.

91. 1300 Medical and Health Camps were organized by the Zonal Railways at different locations which wereattended by 55000 persons both railway employees and their families and also members of public.

92. 22000 staff quarters were taken up for repairs and maintenance in 450 identified railway staff colonies.
93. 590 Yoga camps were organized and attended by 19000 persons.
94. to provide CCTV on coaches without infringement of privacy of women passengers as per specification developed by ICF and accordingly a work  of provision on 500 coaches including 100 sub urban coaches has been sanctioned.



93 23.1.2016 Railway Minister Suresh Prabhu Friday launched a free high-speed public Wi-Fi service at Mumbai Central, the first station in the country to get such facility.
