Sir,

Kindly refer to my letter addressed to H’ the chief Justice dated 1.6.2015 requesting that above appeal be listed before any other authority. The apprehensions contained in my letter have since been proved true. The subject order is not based on legal consideration but result of influence/fear of J Surya Kant. Details are hereunder;-

Sh Sundeep Singh has referred to an order whereby details of Judges medical expenses were denied by Judges of Supreme Court. (How can a judge be a Judge in a case involving judges, (beats common sense)?) Indian jury its social media said this about that order; 

Concealment leads to adverse inference. Judges cannot be a judge in their own cause. The only way to keep their disease or medical treatment a secret would be to incur expenses from personal account. Anything which is paid out of public account is and should be subject to public scrutiny.

Unless the desired information referred to some personal medical disease of J Surya Kant, the aforesaid order (though a nullity) cannot be applied. The information sought related to his leave application for October 10/11, 2013 which led to killing of a young girl. Similarly it is strange coincidence that he took leave for 5.2.2015 when collegiums had met to discuss transfers and postings of high court judges. Leave/tour applications were not related to any medical disease of J Surya Kant. It is thus inferred that the order was out of fear/influence of j Surya kant. The following averment and article 14 of constitution also not applied;-

“copy of leave / tour application of J Surya kant for October 2013 and 5.2.2015 on the ground that it is personal information but he supplied copy of leave application of J Rajive Bhalla vide letter No 532 Dt 3.4.2012 (copy enclosed). Order of PIO No 668 Dt 19.5.2015 is thus discriminatory & violative of article 14 constitution of India.”

Sh Sundeep Singh Registrar Administration, Sh Sunil Choudhary Registrar Judicial and PIO SC Malik cannot be trusted for giving any information relating to a controversial J. Surya Kant. In modern times bonded labour / slaves are not found in some brick-kiln in some remote village of some backward area but in the heart of temple of Justice among above named persons/ Registrars of this high Court.

You had hidden letter of chief justice Dt 6.5.2005 and orders thereon by another Chief justice Dt 6.5.2005 both of which are part judicial record being CWP 6916/2004, certified copy of which is available to a stranger under Rule 2 (iii) of Vol 5 Ch V-B of High Court rules and Orders. The letter by Chief justice B K Roy related to post script order of J Surya Kant dt 14.2.05 in CWP 6916/04. The case related to challenge of govt. allotment of 5.86 acres of land @ Rs 900 sq yards whereas three years to this allotment, adjacent land was allotted to Bar Council of India @ Rs 5,800 per sq yards. 2 sons of a judge were prime stakeholders of allottee. First order pronounced in open court quashed the allotment but post script order of J Suryakant dismissed the writ itself amounting to interference in administration of justice in addition to criminal offense of fabricating orders of High Court.

Desire to hide anything means that you are afraid and fear is bad. Only bonded labourers are known to work under fear.

Sub:  Application for initiation of suo motu proceedings/action preferably by way of Public Interest Litigation with regard to the mishap/accident took place on 11^th of October, 2013 in District Patiala (Punjab) resulting in death of an ITI student namely- Priya Kapor (age-16) being hit by a Fire Brigade Vehicle provided on account of Patrolling Facilities to Justice Surya Kant while crossing Patiala-Rajpura road on that day.

Your Lordship,

                The accompanied press-cutting dated 11^th of October, 2013 of the Newspaper-Hindustan Times, clarifies the whole issue/incident and is self-speaking in itself.  Since, no High Court Judge is provided protocol facilities of any Fire Brigade Vehicle upon journey to his native place, then why said vehicle, which caused death of an innocent person, was involved in the protocol cavalcade of Justice Surya Kant, therefore, this matter attracts the following points for consideration of Your Lordship for taking appropriate action against the wrong-doers and guilty persons:-

(i)     Why said vehicle was involved in the said protocol cavalcade of Justice Surya Kant?

(ii)    Whether Justice Surya Kant was using his official car for personal

tour to Hisar, if yes, then whether it was with due permission of the authorities?

(iii)    If point no.(ii) answers in negative i.e. No, then why such kind of protocol facilities was provided to him for personal tour?

(iv)   If High Court did not provide it than Whether the said vehicle was involved on the directions of Justice Surya Kant or His Secretary and did they gave the tour programme of Justice Surya Kant to O/O Deputy Commissioner Patiala?

(v)    If point no.(iv) answers in affirmative i.e. yes, then whether appropriate action is warranted/required to be taken against Justice Surya Kant for exceeding his permissible limits/powers while acting as a Judge and enjoying of his powers resulting death of innocent person and His Secretary also?

(vi)   If point no.(iv) answers in negative i.e. No, then whether appropriate action is warranted/required to be taken against the person who issued such directions to the District Administration of Patiala including Session’s Office?

(vii)   Whether the matter has been probed/investigated by the Police Authorities as was alleged at the time of incident, as reported?

(viii)  Whether any responsibility has been fixed by any authority of High Court or District Level Administration towards such kind of act of the wrong-doers of such incident?

(ix)   If Judge Surya Kant did not ask for the Fire Brigade why did he not objected to it or asked it to go back?

Exactly a year has gone by and Public is yet to know how a fire brigade vehicle got involved into cavalcade of High Court Judge that killed an innocent young girl. Public is entitled to know the answers.

In view of the afore stated facts and circumstances and keeping in view the fact that now-a-days also in the protocol cavalcades of High Court Judges such kind of unauthorized vehicles are involved and other kinds of protocol facilities are also being enjoyed by High Court Judges like travelling in official cars for personal tours with or without permission, despite they being not entitled for it, it is requested that a stern suo motu notice with regard to this ongoing wrong practice be taken by Your Lordship especially taking action with regard to the afore quoted incident resulting death of a innocent person.

Communists are intolerant of dissent. They give no freedom of speech and hate truth; Their brutal massacre of thousands of students seeking democracy at Tienanmen Square on June 3-4 1989, is well known. Situation is no different in India.

In West Bengal several hundred persons killed; 

a) January 1979; West Bengal On Saraswati Puja Day, the Jyoti Basu-led Left front Government fired, starved, shot and killed Bengali Hindu refugees from Bangladesh, who had trooped into the state and had taken shelter in the Sunderban area. These refugees, largely Dalits who had escaped persecution in Bangladesh and sought shelter in India, were about 60,000 in number and “were taken in by the Left Front’s poll promises and had come over from the rehabilitation centre provided by the Center in Dandakaranya (Odisha)” to Marichjhanpi in Suderban. Tear gas, blockade, firing, burning of camps were the methods used by CPI-M cadres and state police under Left front to disperse the refugees. Many, while trying to escape, fell in the sea to be eaten by crocodiles; many bodies were dumped in the sea as well. Children – 8 years old, 12 years old, women and their babies, men and women in their seventies and eighties were killed in the firing. Till date, the exact number of deaths has not been known.” How many refugees died in police firing and how died when their boats sank while tried to escape will never be known. The refugees were hunted down just because a CPI-M government, led by totalitarian leaders decided that they must be ousted. The CPI-M does talk of human rights and of the need for protecting it, but that talk is only reserved in favour of terrorists like Yakub Memon. Nor have those worthies now protesting at the FTII or their predecessors have ever made a documentary on the Marichjhapi pogrom.

b) April 1982; Ananda Margis from all over the country were headed to an “educational conference” at the Tiljala centre in the southern suburbs of Kolkata when CPI-M cadres led by city leaders struck and burnt them alive. Taxis carrying monks and sanyasins were intercepted at three separate locations, by CPI-M cadres the monks, two of whom were women, were doused in petrol and kerosene, and set on fire. At least 17 Margis were charred to death; several others were severely injured. The lynching was carefully planned and executed by Marxist cadres.

c) July 2000; CPI-M cadres and local leaders killed 11 landless Muslim labourers just because they were supporters of the opposition party and were resisting encroachment and land grabbing on July 27, 2000. The prime witness was also attacked and injured by CPI-M goons. The CPIM’s bike-riding “Harmad Bahini”, spread terror in the region, as it did over the years in areas where the Communist might was politically challenged. The pattern was to intimidate the women, burn huts, beat up and at times hack at the men and set fire to the collected grains before leaving. Often the villagers were compelled to leave the village and live in camps in neighbouring villages or had to leave the state altogether.

d) March 14, 2007; The CPI-M-led government of the “poor and the peasants” tried to forcibly acquire 10,000 acres of agricultural land for a foreign company in Nandigram, in Purba Medinipur district. The farmers having formed a Bhumi Raksha Committee resisted the snatching of their lands. They were first attacked by CPI-M’s Harmad Bahini, who threatened and set fire to the villagers’ huts and prepared the ground that led to firing which saw over 14 farmers die and over 70 getting injured. The real figures will never be known, people saw piles of farmers’ bodies dumped.

In Kerala, UP and Bihar;

Media calls BJP as intolerant whereas reverse is true. Several BJP or RSS workers have been killed in recent past. How many of us know about massacre of innocent BJP or RSS workers in Kerala, WB, Bihar or UP? On February 25, 2016, a Dalit VHP Leader Arun Kumar Mahaur was returning to his furniture shop after offering prayers at a temple near Meer Hussaini crossing, mandola area lucknow when he was shot around 10.30 am. February 15 2016 as 27-year-old RSS worker, Sujit, was hacked to death in front of his aged parents in Kannur Kerala. On 12 February 2016 Bharatiya Janata Party's Bihar vice-president Visheshwar Ojha was shot dead by unidentified gunmen in Arrah area patna on Friday evening. sane day Earlier in morning, BJP leader Kedarnath Singh was shot dead in Chhapra, Bihar. On October 2015 Bajrang Dal activist Prashant Poojary, a 29-year-old flower vendor was hacked to death at Moodbidri Karnataka. On sunday 16th October 2016, Rudresh 35 president of RSS shaka at shivajinagar, banglore was hacked to death. Sachin Shelke, 38 year olf BJP leader and former mayor of Talegoan Municipal Council was shot and hacked to death by a group of persons date 16th october, 2016. Ashwini Kumar, 30, Rashtriya Swayamsevak Sangh (RSS) activist, was hacked to death at kannur kerala. July 2012 Kerala, CPI(M) cadres brutally murdered Vadikkal Ramakrishnan, a mukhya shikshak of locak RSS shakha while he was returning to his house. The Marxists' lust for the blood of the RSS swaymsevaks is never quenched. The Marxists barbarians butchered Shri Pottakadan Shaji, 25, to death on November 16 at Paduvilayi near Koothuparamba in Kannur district. An eight-member hit squad of Marxist goons waylaid Shaji and his friend as they were returning from the RSS shakha at 9 p.m. and attacked them with daggers, axes and bombs. Shaji died on the spot and his friend is battling for life in a hospital. A 45-year-old woman, Savitri, who tried to stop assailants from attacking Shaji was grievously stabbed and later admitted to the hospital. On July 11th 2012, Senior BJP leader S Pugazhendhi (52) was hacked to death near the Nagapattinam police station while he on morning walk. On October 23rd 2012, Dr V Arvind Reddy (38), the BJP State Medical Wing Secretary and Indian Medical Association (IMA) Vellore Branch President, was murdered in front of the diabetic clinic owned by him. On March 19th 2013,  K. Murugan (45), former BJP municipal councillor, was returning home for lunch when the gang hurled pipe bombs and hacked him to death in broad daylight in the Paramakudi main bazaar. On February 17, 2016 Country-made bombs were hurled at a Seva Kendra run by the RSS and at the residence of a BJP worker at Thalassery in the district. On July 7th 2013, 55-year-old Kuttai nambu, secretary of the Hindu Munnani’s Rameswaram unit, was found dead with injuries in the head and chest caused by a boulder. On 25.2.2016 a dalit VHP Leader Arun Kumar mahaur in Mandola area. On 25.8 2016 Sh Sugesh a BJP worker was hacked to death by a mob of 30 CPM goondas at Kannur, Kerala. On 8th October, 2016, CMP workers hacked to death Vishnu a young Dalit Worker and leader of BJYM from Trivandrum, they did not even spare his mother and aunt both of whom are in critical condition. On Wednesday, 12.10.2016 Ramith (29), a BJP worker was hacked to death by Marxists in broad daylight at Pinarayi Chief Minister Pinarayi Vijayan’s native village in Kannur district. Ramith's father Uthaman was killed in 2002 by CPM workers, who forcefully dragged him out of a bus he was traveling in and hacked him to death. A 20-year-old BJP worker Nirmal was hacked to death BY CPM Goons in north Kerala’s Thrissur on 12.2.2017 night. The latest murder is barely a month after the killing of three BJP workers, one in trouble-torn Kannur and two in Palakkad since C Sathosh (52) was killed in chief minister Pinarayi Vijayan’s constituency in January. Santosh a Bharatiya Janata Party (BJP) worker was stabbed to death allegedly by Communist Party of India (Marxist) (CPI(M)) activists at Andaloor in Dharmadam, the constituency of chief minister Pinarayi Vijayan on 18.1.2017. The attack on Santosh (52) took place when he was alone in his house. In another incident on 19.1.2017, a country bomb was hurled at the Rashtriya Swayamsevak Sangh (RSS) Karyalaya at nearby Thaliparamba. 4.03.2017; Four Rashtriya Swayamsevak Sangh (RSS) workers and One BJP worker were attacked on Saturday by (CPI-M)  Chinese@Communist Party of India (maovadi@Marxist) workers in Kerala's Kozhikode district. all are admitted to Hspital in serious condition with injuries all over. 17 BJP and RSS workers were killed in Kerala in the last 17 months feburary 2016- june 2017 including Pramod, Ramachandran, Vineesh, Vishnu, Ramit, Anil Kumar, Radhakrishnan, Vimla, Santosh, Nirmal, Ravindranath, Sujit, Biju and Rajesh One Rajesh had received 80 wounds. His hands were chopped off.  the place where Rohith Vemula hailed from had witnessed 50 incidents of attacks on women, many of them Dalit. CPIM don’t want another Ram Nath Kovind to be born because the politburo [of the CPM] has no Dalit.

In Punjab;

In 1978, GS Tohra President of SGPC and Marxists joined hands. Harkishan Singh Surjeet a communist became Rajya Sabha MP with help of Akali MLAs. Marxists infiltrated gurudwaras as jathedars. (Marxists teach hate for religion). Religion is viewed as opium and one that retards a human. The Gurudwaras which came under communists control, were converted into heavily fortified military bunkers and then followed a reign of terror similar to one seen after French and Russian Revolutions. A total of 11,694 innocent persons were massacred in Punjab during 1981-1993, out of which 7,139, i.e. more than 61 per cent were Sikhs.
